1. Steps Process

  • Determine if Hague Convention applies — Both countries must be signatories, child under 16, removal was wrongful.
  • Contact US Central Authority — 1-888-407-4747 or travel.state.gov.
  • File application for return — Submit to appropriate Central Authority with child identity, circumstances, and custody documentation.
  • Central Authority processes — Locates child, attempts voluntary resolution, facilitates legal proceedings.
  • Court proceedings — Court where child is held determines whether to order return.
  • Return of child — If ordered, child returns for custody determination.
